Katke guilty plea to stand despite successful appeal in related case

Former RBS CLO trader Matt Katke, who pleaded guilty to securities fraud charges in March, will likely be unable to withdraw his plea following a successful appeal in a related case

I've never heard of the ability to submit a plea that is conditional on some future court ruling in a different case. It reminds me of the "bids" and "offers" that HFT algorithms negotiate with trading exchanges. Can we create the term "spoof plea," then?!
