There are very few times in life when I've wondered if I should be a lawyer. This may be one of them. The legal issues (to this non-lawyer) appear fascinating. Can a CLO SPV file suit of this sort? Apparently it's not the Trustee filing suit, it's the legal entities of the three deals. I don't believe CLO documentation is constructed to fight alleged fraud in this manner.
